Mayor Wilson wanted me to share his view on this with all of you on the board:"If we pulled the CO, which I not sure is legal, Kerry Higgins will have to weigh in on that. We would, then, be responsible for relocation of all tenants. That fact I am sure of. I’ve been informed by Hank Stryker that the cop is removing the tenants, himself. That’s the best way to go for us.
Second, the ABC has NO jurisdiction in this because there is no beverage license, involved.
We can inform ICE of this (illegal immigrants, involved). So what! They won’t do anything. Its not a felony!
As for the Out-of-Town comment regarding that other police department... the Wall PD is doing an internal investigation, as they should. This is already strike two or three against this officer. What happens in Wall is their business. We’ll take care of this guy in OUR own court!
As far as the one person who wrote in about us letting this happen, to all the critics, we are handling all of this in the appropriate way. Everyone has the right to voice their opinion but we must obey the laws in handling this situation and WE ARE!
To those very quick to pass judgment on this matter: I believe they are nothing more than ‘MONDAY MORNING QUARTERBACKS." We'll do what we can do and nothing less.
Mayor Wilson Marc, I first want to thank you for sending us the message from the Mayor. I also thank you for your participation today, as with any day. You are an asset to not only this site, but the town. Brian Open letter to Mayor Wilson Mayor, Today I sat down at my computer with my first cup of coffee in hand, as I do every morning. I do this every morning to monitor and ensure that no inappropriate posts have come in over night. And they do at times! Anyway, I d**n near spit my coffee all over the screen when I read about this case. I could not believe that these people would do the same thing all over again. When I wrote my commentary following the article, I was infuriated. My post was not an attack on you or the council. Just the opposite. In the article, Mayor, you had some strong words about this. You, me and every other law abiding citizen in this town should be infururiated at this. Our town had had to deal with things that we should not have to. We did not ask for it. But these problems are here and have to be dealt with. Every citizen will be watching. I petition all of you in our governing body to go on the offence. For far too long we have been on the defence in this town. This restaraunt is a perfect opening to set the example toward those who would ruin our town. The slumlords are running rampant. For far too long Freehold Borough has been looked down upon and spit at by others who do not care about the betterment of our community. My message to you, Mayor Wilson, is to throw everything you have at these people, these deviants. And then publish it, loud and clear, that Freehold Borough will not tolerate those who would hurt us. Our citizens are craving a moral victory. We need a win in our column. We need hope. We need to see that we can get the upper hand. The law is on our side on this issue. So is public sentiment. Now is the time to grab the bull by the horns and really show who is in charge of this town. I was not going to bring it up, but it has been mentioned in this thread anyway. The deputizing of our officers to deal with illegal immigration-- 287g. This is a lawful and legal program that we can participate in. There is no reason not to. We have learned, as a town, that other agencies have left us to rot when we needed them. 287g is something we can do. Mayor, I will not go too much further, but if we should ever get the chance to talk in person, and in private, I can ensure you that you will be sold on this idea and realize that we have to adopt the 287g. The ball is in the hands of our town. As citizens we will hope that you will act in a lawful, prudent, and aggresive way in dealing with the restaraunt. We will all be watching. Brian

Someone I know was pulled over in Wall Township for not having his name on his cargo van (however the van isn't registered as a commercial vehicle, rather it's a personal automobile) and the illegal he had in the van with him was arrested and taken to the County lockup. He's currently on his way back to South America. How ironic that a Wall cop has admitted illegals living in his rental units and sees nothing wrong with that yet they pull law abiding citizens over for nothing and deport illegals for nothing more than getting a ride home.

However, to come out and imply that the officer from Wall did something wrong just because he owns a few properties "on a policeman's salary" is irresponsible. From what I can tell a coupe of you seem to be a little envious of the Wall officer that owns properties in town, and I think that’s where the outrage lies, let’s beat these guys down because they have attained too much and I have not. I would suggest that a call to the NJ State Division of Taxation would be in order as well. Restaurant meals are taxable in this state, and unless the illegal restaurant operator aquired a TIN and was collecting & remitting the requisite 7%; she is in violation and can (and should) be prosecuted and even jailed for that ommission. Mr LeVine, can you tell us (if you know) whether the other rental properties owned or co-owned by Officer Dirtbag have been or are being checked out for similar activity? Borst owns the following: 16 FACTORY STREET (bought 9/19/06 - right after his last bust) 52 WEST GEORGE STREET (bought 12/16/04) 58 MECHANIC STREET (bought 12/27/04) 19 BENNETT STREET (boght 8/19/04) 24 BOND ST (bought 3/21/03) Not bad for a policeman's salary. And wouldn't you know, he owns no other Monmouth County properties! I note in the past that he has owned unuder different corporations, such as BORMAS (the first three letters of his last name and the 1st three of his partner's name) and under DB Real Estate. So he may have some more properties under different names. In Ocean County, he owns... well, it doesn't seem that he does not own any properties. interesting.

Uh.. No Zeus. How about the fact that there is someone from ANOTHER town coming to OUR town and ruining it? How about the fact that someone is running a RESTAURANT out of a residential neighborhood in the basement or living room of a HOUSE?? I'm looking to buy a condo or rent an apartment out in Los Angeles. When I'm not at that location for six months, I wouldn't expect the people I'm subletting it out to to run a restaurant or any other type of illegal operation. Stop making excuses for illegal behavior. FR

The outrage lies in the fact that a police officer is not just supposed to enfored the law, he is also obligated to obey it. Since Officer Scumlord admits that he has ignored the law in the past, I am very comfortable with assuming that he has done so again. And spare me the "just because he owns a few properties" bull. He allowed his tenant to operate an illegal restaurant, where she sold alcoholic beverages sans license. He was also cited for and admitted to overcrowding, or, in language you can understand allowing those precious illegal aliens you come here to champion to sleep in the basement, in violation of his CO - his "contract" with the town. So, he's not Horatio Alger, he's not Robin Hood, he's not some poor schmuck who made a little mistake... he's dirt, and should be regarded as such. (Unless actual dirt complains about being compared to him, in which case I will concede that he is slime.)

A tenant does not have the right to sublet the property you do not own. The land lord may not care, they get the money either way, but the municipality may have Subletting laws on the books, you too are breaking the law! I know you want to respect the LA LAW, as you would expect folks to respect FB LAW, FR! PS, interested in a REASONABLE apartment in Beverly Hills? I know some one, who knows some one!!! ;D

The LLA has to look at ALL suspected Latino-police interaction in Monmouth County. If there is truth in this report, then the Wall Police are profiling racist scum. Is there a phone number to call and report this? This injustice must be investigated and stopped. This goes well beyond a councilman's poorly worded statements. This is abusive law enforcement. LLA where are you?

Your speaking for yourself, and a vast minority of uninformed fledgling, amateur real estate investors. The path to financial failure is to not protect your investment. Most mortgage companies require the landlord/property owner to secure verifiable credit background checks for applicant tenants. Unfortunately, most mortgage companies never stay on top of mortgage holder-landlords. Renting to a tenant with out a verifiably credit background is foolish, invites trouble and will be problematic. We see this today and this is happening all over the Boro. Only a greedy fool would loan money, or provide goods to an unverifiable stranger. This is a fact and this is what happened DR Zeus. Borst should be reported to the IRS, as well should the illegal alien restaurantour tenant. And then swiftly deported. Further Zooos, "couple of you seem to be a little envious", you are incorrect AGAIN, most of us are outraged by this landlords lack of respect to a community he profits from. The derogatory comments by Wilson against his own taxpayers are despicable, calling his own town's law-abiding citizens "Monday morning quarterbacks" and other defenses...when he himself was acting on misinformation regarding the liquor license (and who knows what else), and "posting" comments through someone else. There is no excuse for this "restaurant" to have continued. If the slumlord cop is removing the tenants, supposedly, why didn't this happen the first time?
But, we've voted Wilson in for 20 years. We get what we deserve.

Go to council meeting...I certainly have and certainly will again. Voting booth...certainly have and certainly will again. Maybe a large number of us have valid reasons for staying anonymous, considering past history and notices for "infractions" on our property when we speak out.

This is not a totalitarian state (figure of speech). I have heard the situation, people getting nailed with $1000.00 fines for blow-up pools yet scum-lords with restaurant in private homes seem to go unpunished with token cost of doing business fines! I am going off topic here but.... The cost of policing Rental Property and the added burden to code enforcement adds significant cost of operations to the Boro. When a single mother with one child home owner pays close to $9k, yet an owner of a garden apartment complex with 30 units pays $90K (will double check my facts, but I believe these numbers are close), there is an inequity! Yes there are many inequities and your quite concerns expressed in the shadows of "Angry Guest" anonymity must be addressed, or there will be an exponential growth in the number of "for sales signs". May be homes owners are easier targets for summons based revenue streams, then generating a viable and significant revenue stream from the hoards of absentee landlords should be examined. So, would it be feasible to increase the Rental Property taxation with a PREMIUM on rental property, while offering an abatement to IN-BORO Resident landlords?

Fiber, I am with you in your point about getting people to meetings. I do have to correct your numbers on this site. There are at least eight registered users who post on a regular basis. At least that many more post periodically. There are several regular guests. The readers are the biggest mystery. There are many more than participants. I do know that some of our registered and past users are reading more than posting. There is a huge number of non participants who just read. I can only estimate, but I put that number into a couple of hundred, at least. This thread alone has drawn out about ten or eleven regular participants. Look at the above, and it is not so bad for a small town web site.

I commend the mayor for trying to reach out to people on this site. I have built my career on communication and edification, and I appreciate the fact that he made the effort to demonstrate concern and his initial thoughts. He proved he cares, otherwise he would not have done it. Now, for those who don't agree, who hold different opinions on what can be done, air them out at the council meetings. These meetings have a public commentary portion. There are seven people including the mayor, who would greatly appreciate commentary, no matter how impassioned, and would welcome questions and ideas. And attorney Kerry Higgins is a wealth of knowledge who can translate law into concise and clear verbiage. Communication is a start. A word of caution -- a lesson learned from my grandmother: There's a right way to express your opinion and a wrong way. In other words, don't degrade someone personally, that amounts to empty words. Now let me comment on the idea that there are those of us who remain anonymous... I can't speak for others, but I choose to remain anonymous for the reasons mentioned by one of the other posters...Mayor Wilson and the town has a knack for slapping fines on those they feel threatened by. I used to have a friend who lived here in town, she would constantly be calling the police to complain about illegals who would gather in front of her house while looking for work, she wrote many letters to the various newspapers in the area regarding the lack of effort from the Mayor and town council to do anything about the illegal aliens that were coming into the town, she was an active thorn in their sides trying to get them off their a$$es and do something. And what did she get in return? Did the police ever chase away those gathering in front of her house? Nope. Did the town council or the Mayor do anything to stem the flow of the illegals into town? DEFINITELY NOT. What my friend got was constant harassment from the police, code enforcers and whoever it is that they send around to give you fines for not having everything inside and out of your house exactly in line with the town codes and laws. I am not talking about major items here either folks, I am talking about fines for not shoveling her sidewalk completely in the winter and other such ridiculous "offenses". Back a number of years ago, current Democrat Marc Levine ran as a Republican for the town council with Peter DeFonzo, another Republican, and they had the late Jeff Jones as a Republican candidate for Mayor. Wilson knew that Jones would be a serious threat to his happy little home in Borough Hall, so suddenly certain stories came out about Jeff Jones and his history before he sobered up and straightened out his life. Marc, if you really are as honest as you claim to be, why not tell the people on this board about some of the things that happened??? I am sure you know much better than the second and third hand stories I have heard. But, as I and some others have mentioned, the people of Freehold Borough continue to vote this guy into office. And what is almost more disturbing is the fact that people on this site seem to consistantly defend the man as well...Brian, you, sadly, are one of them. So, even if I could make it to a council meeting, why should I make myself a target for the Freehold Borough Mayor's wrath? Sure, I may get my point across and I may even get some applause from the audience, but the reality is that it will go in one ear and out the other of the Mayor, and the Council too for that matter ( no one ever seems to respond to the accusations that these very same council members have been around while the whole illegal problem started - and they did nothing!!!). So, I'll get some applause, and then I'll have somone knocking on my door to tell me that the shed in my back yard is too close to the fence, or that my fence is not high enough to meet the local code, or that I didn't shovel my sidewalk in time, and then I'll be slapped with some ridiculous fine, while officer slumlord pays a thousand dollars for housing illegal aliens and allowing them to run an illegal restaurant out of his basement, for a second timeNo thanks. Instead I have finally come to the conclusion that nothing is ever going to change in this town, and therefore it is time for me and my family to change towns. I would hope that the perception of my honesty and integrity is shared by the many who really know me, rather than you thinking it is some myth I am trying to instill. I took it on the chin pretty hard for our town, last November. I think my honesty and integrity eventually won the day with many who supported me.
Regarding the late Jeff Jones and his attempt to become Mayor of this town, Jeff DID, in fact, have a less than noble past that - during the political campaign - the Democrats DID try to expose and exploit. It WAS unnecessary and it WAS ugly.
When I ran for office with John Rosseel in 1990, the Republicans, behind us, released some stinging rumors about former Councilwoman Lynn Reich, which I asked them to discontinue. The things said were equally bad and distasteful. But, these kind of things happen during a campaign.
Let me remind you that behind the scenes there are many organizers that many residents are not aware of. The Democrats always had Jamie Gilmartin, who could be rather tough on us Repubs. Us Repubs had people like Rob Nixon, Tom Apostle, Don DeSanto, Tom Barkalow and others, who also tried their best to end the Dems lock on town hall. It often got carried away. I do not like this part of the political process, but it part of nearly all campaigns. Freehold Borough's are alot milder than Marlboro's, Manalapan's and Howell's, though. Freehold Township? Nah. No one even challenges those GOPers.
Viewing the Mayor, first hand, during the last couple of Dem contests, he is not exactly the poltical "braintrust" us Repubs thought he was when we challenged past Dem tickets. The Dem committee, like the Repubs, still has a few pretty savvy party leaders that can handle campaign strategy during elections, quite effectively. Many times the Mayor isn't even at the campaign meetings.

You make a great many points in your post that I agree with, but I have to address the above quote form you.
I want you to show me where I defend the Mayor. I want you to show me what choice I have. We do not even have a race this year, and as I stated in another post, that is a crime.
What do you want me to do? Turn this site into a slug fest with malicious posts? Just the opposite. I try like hell to invite people to participate on this site. I have tried to get more elected leaders to participate. To their credit, we do have Marc and Andrew DeFonzo. And Marc has already received a good kick in the teeth for his participation. Don't you think the other elected leaders took note of that? At least the Mayor has sent messages to us. He has already reached more people with that message than he does in any council meeting.
As the admin, I have want to be inviting to all. Take note of the fact that I defended Zeus the other day. I often disagree with her, but she does present a view point that should not be silenced.
If I am not beating up the Mayor enough for you, too bad. If you think for one second that I do not share your frustrations, you are dead wrong. All of the people on this site do.
If you think for one second that I think everything is rosy, you are dead wrong. Believe it or not, even with all of the posts I have on this site, I do refrain from going all out. There is a lot more I could write.
The one thing I have defended the mayor and Council against is when people give them unreasonable heat. I want you, Angry guest to go to the illegal immigration thread and answer the challenge " What Would You Do?" which was posted by Rich Kelsey.
If you take a good look at all my writings, you will see that I do believe in doing things that are not being done. I know mistakes have been made, and I know this town is on the brink of either going down hill really bad or getting up and going in the right direction.
What would you do if you were mayor, Angry Guest? Put your money where your mouth is and answer that.

Plain and simple: after the last bust on this place, the council and code enforcement should have been aware (especially after the posts here) about the proper procedures. Going in without the ABC and state police smacks of the locals trying to get the glory for themselves. Instead it looks like they screwed up the whole thing again.
P.S. I did the research myself on the CO (the code is located at the town hall and at the library, FYI). There is already an ordinance on the books regarding pulling a CO. I assume that legal research was done prior to enacting that section.

Calliope- You need to take a good look at Carmens organization as I just did, she speaks the truth, and is on target. I have had the pleasure of speaking to Carmen and her associate Miguel the night of the event and several times since then. Your "word on the street," was incorrect. Carmen knows me for awhile and saw what was happening here on March 6th. She came all the way down from North Jersey to stand with me and stand against those coming to attack Freehold Borough. She saw through the ruse that night - as she told me. She knew it was a pre-emptive strike against a major critic of the local situation by the facilitator of the rental committee recommendations. She also knew Freehold Borough was going to take it on the chin, as a result.
Yes, she came here to oppose illegal immigration. She could have gone elsewhere to do that. But, she came here because she recognized a friend in need and a town under siege. I do not want to minimize her's or Miguel's good will and their real/sincere interest in coming to town - as she expressed to me and others.

But, as I and some others have mentioned, the people of Freehold Borough continue to vote this guy into office. And what is almost more disturbing is the fact that people on this site seem to consistently defend the man as well...Brian, you, sadly, are one of them.Angry guest, You make a great many points in your post that I agree with, but I have to address the above quote form you. I want you to show me where I defend the Mayor. I want you to show me what choice I have. We do not even have a race this year, and as I stated in another post, that is a crime. What do you want me to do? Turn this site into a slug fest with malicious posts? Just the opposite. I try like hell to invite people to participate on this site. I have tried to get more elected leaders to participate. To their credit, we do have Marc and Andrew DeFonzo. And Marc has already received a good kick in the teeth for his participation. Don't you think the other elected leaders took note of that? At least the Mayor has sent messages to us. He has already reached more people with that message than he does in any council meeting. As the admin, I have want to be inviting to all. Take note of the fact that I defended Zeus the other day. I often disagree with her, but she does present a view point that should not be silenced. If I am not beating up the Mayor enough for you, too bad. If you think for one second that I do not share your frustrations, you are dead wrong. All of the people on this site do. There is a lot more I could write. The one thing I have defended the mayor and Council against is when people give them unreasonable heat. I want you, Angry guest to go to the illegal immigration thread and answer the challenge " What Would You Do?" which was posted by Rich Kelsey. If you take a good look at all my writings, you will see that I do believe in doing things that are not being done. I know mistakes have been made, and I know this town is on the brink of either going down hill really bad or getting up and going in the right direction. What would you do if you were mayor, Angry Guest? Put your money where your mouth is and answer that. Brian As a side note, I also want to give credit to Councilman Jaye Sims. He has placed a couple of posts on this site on his own. Angry guest, You might be interested to know that not only do I have you accusing me of defending the Mayor, but on the flip side I have also taken heat for just the opposite. I have had people approach me and raise concerns that I promote a right wing and Republican friendly stance. I have had people express concerns of partisanship on this site. I feel like Bill O'Reilly, everyone thinks something a bit different of what they see on this site. It all comes down to the perceptions and bias of individual readers. Either way, my goal on this site is to keep it open to everybody in Freehold Borough.

Dear Jupiter, Thanks for your insights! Again, with Carmen's letter, I just felt immediately that that second to last statement was unnecessary. Otherwise, it was wonderful. I am in agreement with a lot of the frustrations about the repercussions of unstemmed illegal immigration. However, as I have always said, I don't want to see this degrade into a solely ethnic issue. Listen, growing up in Holmdel, in the early 1970s, my family was the only Jewish family on the block. I remember being made fun of, being chased by neighborhood kids, my family being picked on, and our home being egged. Bad memories because it hurt deeply. Thankfully, a few years later, several other Jewish families moved in and the hecklers moved out. But, the memory of how it felt to be an outsider, to be picked on remain, and do drive a lot of my compassion and empathy. By the way, I don't smoke wacky tobaccy! That made me laugh. Hi Calli...That entire letter was unnecessary! As Brian pointed out, it was not posted by Carmen. I agree with her message, however posting someone else's private letter/email is poor TECHNO-Etiquette, regardless of the message! IMO Carmen twist on WAKEUP AND SMELL THE COFFEE was appropriate, as long as there was no derogatory reference to a particularly groups hygiene, and I do not think that is was a derogatory reference to hygiene. This was just a spin on a colloquial expression. Wow, I didn't think that there was such Anti Semitic activity in Homdel, I guess "you cant judge a Goy by his/her Homdel" then! I lived in FLA for a few years, and I knew folks were amazed at how well hidden my Horns were, and these were people you think, with their fine University Education, had been smarter. BTW, not even Wowie Maui, on a misty rain Monday, while the de'crop is be'n cultivated M'ON? Cheers!

This is the last time I will say this. Be very clear that I am not "defending" the Mayor. He doesn't need me for that. MY ONLY interest in all this is to see those involved in this illegal restaurant get the book thrown at them!
This all happened while I was away and just returining. I am currently doing my own fact finding on this situation. Protocols WERE established when this happened the last time and I was directly involved in those discussions. I was assured that we would do better the next time. I, like all of you, expect accountability here.
My statement that the Mayor was "misinformed" on the ABC was correct and he does stands corrected. Meanwhile, I am advised they (ABC) ARE investigating the matter. Until I learn at what point they were called in and by whom, I cannot make a determination of anything more about their value here. And, until I can tell what their role will be and it's effect, I can't tell anything of their efforts.
Folks, this is all still an active investigation and is still playing out. As it unfolds, we'll see exactly what has been done here. It's too soon for anyone to jump to any conclusions. All that I know is that if justice isn't done here, I will be very unhappy and you can expect me to also start pointing fingers at ANY AND ALL of those, who had the directives, in hand, but failed to follow them. MUCH TOO SOON FOR THAT.

First, was there a commercial enterprise in a private home for a 2nd time? Was Alcohol illegally dispensed for a 2nd time? What was the Immigration Status of the alleged Perpetrators for a 2nd time? Was the restaurant in operation, with Diners on site at the time of the raid, were these People detained for questioning, and what was THEIR immigration status for a 2nd time? Was the NJ Department of Revenue involved, since there has been sales tax revenue denied to the state for a 2nd time? Has the IRS been involved Since here too, the Illegal Business had not been reporting income for a 2nd time? Was Home Land Security/ICE called about the known Illegal Alien status of the tenants for a 2nd time. Was the Cert. of Oc. pulled until all complaints had been answered due to a commercial enterprise operating in a private home for a 2nd time?

Except for the fact that a homeowner might get Cirrhosis of the liver, drinking it, we need to find out if they were nailed selling it! See my point? Marc I know, THE JUDGE needs to dissect the duck to be certain it is a Duck found in the Basement. There was a search warrant issued, so there must have been some preponderance of something wrong in order for secure the search warrant. But your right, lets not jump to conclusions.

I parallel this with narcotics sales. The presence of cash could imply sales.
